Agreement to Our Legal Terms

We are Asbury Heights (“Company,” “we,” “us,” or “our”), a senior living community located at 700 Bower Hill Road, Pittsburgh, PA 15243, United States, and owned by Oakdale Seniors Alliance.

(the “Site”), as well as any other related products and services that refer or link to these legal terms (the “Legal Terms”) (collectively, the “Services”).

These Legal Terms constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you”), and Asbury Heights concerning your access to and use of the Services.

By accessing or using the Services, you acknowledge that you have read, understood, and agreed to be bound by these Legal Terms. If you do not agree with all of these Legal Terms, you must discontinue use of the Services.

Supplemental terms and conditions or documents that may be posted on the Services from time to time are incorporated into these Legal Terms by reference. We reserve the right to make changes or modifications to these Legal Terms at any time. Changes will be reflected by updating the “Last updated” date.

It is your responsibility to periodically review these Legal Terms to stay informed of updates. Your continued use of the Services following the posting of revised Legal Terms constitutes your acceptance of those changes.

The Services are intended for users who are at least 18 years old. Persons under the age of 18 are not permitted to register for the Services.

The information provided when using the Services is not intended for distribution to or use by any person or entity in any jurisdiction or country where such distribution or use would violate applicable law or regulation or subject us to any registration requirement within such jurisdiction or country.

These Legal Terms and your use of the Services shall be governed by and construed in accordance with the laws of the Commonwealth of Pennsylvania, without regard to its conflict-of-law principles.

13. Dispute Resolution

Before initiating formal legal proceedings regarding a dispute arising from these Legal Terms or use of the Services, the parties are encouraged to attempt to resolve the dispute through good-faith informal negotiations.

Nothing in this section prevents either party from seeking relief available under applicable law.

Any dispute that proceeds in court shall be subject to the jurisdiction and venue requirements provided by applicable law.

WE DISCLAIM WARRANTIES, EXPRESS OR IMPLIED, REGARDING THE SERVICES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT TO THE EXTENT SUCH WARRANTIES MAY LAWFULLY BE DISCLAIMED.

WE DO NOT WARRANT THAT THE SERVICES WILL BE ERROR-FREE, UNINTERRUPTED, COMPLETELY SECURE, OR THAT ALL INFORMATION AVAILABLE THROUGH THE SERVICES WILL ALWAYS BE COMPLETE OR CURRENT.

16. Limitations of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, ASBURY HEIGHTS AND ITS OWNERS, AFFILIATES, DIRECTORS, EMPLOYEES, REPRESENTATIVES, AND AGENTS SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICES.

Nothing in these Legal Terms excludes or limits liability that cannot lawfully be excluded or limited.

To the extent permitted by applicable law, you agree to indemnify and hold harmless Asbury Heights, its owner, affiliates, officers, agents, partners, employees, and representatives from claims, damages, losses, liabilities, and reasonable expenses arising from:

1. Your unlawful use of the Services;
2. Your material breach of these Legal Terms;
3. Your violation of the rights of another person; or
4. Content or information you submit in violation of applicable law or these Legal Terms.

Our collection and handling of personal information is subject to our Privacy Policy and applicable law.

Nothing in these Legal Terms creates a joint venture, partnership, employment, or agency relationship between you and Asbury Heights.
